Terms of Service
These terms govern use of Hermes Bot ("the bot"), a personal Discord application operated by Henry Condon ("the operator"). By interacting with the bot in a Discord server, you agree to these terms. If you do not agree, do not interact with it.
1. What the bot is
Hermes Bot is a self-hosted, AI-assisted Discord bot run on the operator's own hardware for personal use. It is a private application: it is not publicly listed, and it only operates in servers the operator owns or has been directly invited to by that server's administrators.
It is provided free of charge. There is no subscription, no paid tier, and no purchase of any kind.
2. Eligibility
You must meet Discord's own minimum age requirement — 13 years old, or older where local law sets a higher minimum — and be in good standing under Discord's Terms of Service. Your use of Discord itself remains governed by Discord's Terms of Service.
3. Acceptable use
When interacting with the bot, you agree not to:
- Use it for anything unlawful, or to produce content that is illegal where you are.
- Use it to harass, threaten, defame, or target any person or group.
- Attempt to extract the bot's credentials, access the operator's systems, or use the bot as a route into infrastructure you are not authorised to reach.
- Deliberately overload it, script abusive request volumes against it, or otherwise disrupt its operation or the server it is running in.
- Attempt to make it violate Discord's Terms of Service or Community Guidelines.
- Submit other people's personal or confidential information without a lawful basis for doing so.
4. AI-generated output
The bot's replies are produced by language models. This has consequences worth being explicit about:
Output may be wrong. Model responses can be inaccurate, outdated, incomplete, or entirely fabricated while sounding confident.
Output is not professional advice. Nothing the bot says constitutes legal, medical, financial, or other professional advice, and it should not be relied on as such.
Verify before acting. You are responsible for checking anything you intend to act on, and for any consequence of acting on it.
The operator does not review responses before they are sent and does not endorse the content of model output.
5. Availability
The bot runs on a single personal workstation. It may be offline, slow, or mid-upgrade at any time, without notice. No uptime, availability, or continuity of service is promised. The operator may modify, suspend, restrict, or permanently discontinue the bot, in whole or in part, at any time and for any reason.
6. Suspension of access
The operator may block any user or leave any server at any time, for any reason, including breach of these terms — with or without prior notice.
7. Your data
What the bot accesses, how it is processed, and how to have it deleted is described in the Privacy Policy, which forms part of these terms. Note in particular that while most processing happens locally on the operator's hardware, some tasks may be sent to a third-party model provider.
8. Intellectual property
You retain any rights you already hold in the content you send to the bot. You grant the operator permission to process that content solely to operate the bot and respond to you.
The operator claims no ownership over model output. Because AI output may be non-original, may resemble existing works, and may not be copyrightable in some jurisdictions, no warranty is made as to your ability to own, register, or exclusively use anything the bot produces.
9. Disclaimer of warranties
The bot is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. You use it at your own risk.
10. Limitation of liability
To the maximum extent permitted by applicable law, the operator is not liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, profits, goodwill, or opportunity, arising from your use of or inability to use the bot — including any reliance on its output.
The bot is offered free of charge and as a personal project; to the extent any liability cannot be excluded, it is limited to the greatest extent the law allows.
11. Indemnity
You agree to hold the operator harmless from claims arising out of your misuse of the bot or your breach of these terms.
12. Relationship to Discord
Hermes Bot is an independent project. It is not affiliated with, endorsed by, or sponsored by Discord Inc. "Discord" is a trademark of Discord Inc., used here only to identify the platform the bot runs on.
13. Governing law
These terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these terms or your use of the bot shall be brought exclusively in the state or federal courts located in the State of Washington, and you consent to the personal jurisdiction of those courts.
Nothing in this section deprives you of the protection of any mandatory consumer-protection law of the jurisdiction in which you reside.
14. Changes to these terms
These terms may be updated. Material changes will be reflected in the date at the top of this page. Continued interaction with the bot after a change constitutes acceptance of the revised terms.
